📖Detailed Analysis

No statewide ADU law. HB 409 (2023) passed the House but died in Senate Rules committee (April 2023). New S495 (2025) proposes statewide reform requiring local governments to allow at least one ADU per single-family dwelling, with minimum allowable size of 800 sqft. Currently local control: Raleigh has ADU ordinance, Wake County requires ADUs to have own kitchen/sanitation/sleeping and one off-street parking space. ADUs reviewed under NC State Residential Building Code when resulting in 2 units per parcel. Legislative momentum building but no statewide mandate yet.
